The 37-year-old actor was taken into custody on April 17 at Mammoth Mountain ski resort in California.
According to PEOPLE, Osment was arrested for public intoxication and possession of a controlled substance. He has since been formally charged with possession of cocaine and disorderly conduct, the Mono County District Attorney's Office revealed.
Bodycam footage from the incident reportedly shows the actor behaving erratically, shouting phrases like “I’m being attacked” and “I’m an American” when asked for his name.
At one point, he tells officers, “I’m being kidnapped by a f**king Nazi.” He was searched, and a $20 bill containing an unknown substance was found on his person. Osment later called the arresting officer a racial, antisemitic slur.
Witnesses at the scene told police that bar staff had cut Osment off from ordering more drinks after he spilled one, leading him to become “aggravated.” He then attempted to board a ski lift, prompting employees to deny him access and call police.
Despite the severity of the incident, he appeared unfazed in his mugshot, flashing a wide grin as he was booked. He was released shortly after.
Following the arrest, the Forrest Gump star issued a public apology through the publication, addressing the use of an antisemitic slur captured on police bodycam footage.
“I’m absolutely horrified by my behaviour. Had I known I used this disgraceful language in the throes of a blackout, I would have spoken up sooner,” he stated.

He added that losing his home in the Altadena wildfires earlier this year had left him in a “very low emotional place,” but stressed: “That’s no excuse for using this disgusting word. From the bottom of my heart, I apologize to absolutely everyone that this hurts."
"What came out of my mouth was nonsensical garbage - I’ve let the Jewish community down, and it devastates me. I don’t ask for anyone’s forgiveness, but I promise to atone for my terrible mistake," he concluded.
Osment’s arraignment is scheduled for June 7.

This is not Osment's first encounter with law enforcement.
Back in 2006, at age 18, he was charged with drunk driving and marijuana possession following a car accident. He pleaded no contest and was sentenced to three years’ probation.
More recently, in 2018, he was involved in a verbal altercation at McCarran International Airport in Las Vegas during Super Bowl weekend.
Osment first rose to fame in the 1990s with breakout roles in Forrest Gump, where he played Tom Hanks’ son, and later in The Sixth Sense, which earned him an Academy Award nomination for Best Supporting Actor at just 11 years old.
He later starred in films like Pay It Forward, Secondhand Lions, Tusk, and Extremely Wicked, Shockingly Evil and Vile, as well as numerous television roles.
Despite fading from the mainstream spotlight, Osment has continued to work steadily in the industry and pursued higher education at NYU’s Tisch School of the Arts.
He is the older brother of Hannah Montana star Emily Osment, who also starred alongside him in The Kominsky Method.
