KJ Biermann, 15, accused of shocking act involving underage relative after prosecutor reveals what was allegedly found on his phone
A bombshell revelation in court has revealed previously unreported allegations involving KJ Biermann, the 15-year-old son of reality star Kim Zolciak and former NFL player Kroy Biermann, who stands accused of sexual assault.
KJ appeared before Fulton County Superior Court in Georgia on Friday as a judge considered whether he should be released on bond following his arrest over separate allegations involving a female classmate.
Disturbing revelation about another alleged sexual assault
During the hearing, Deputy District Attorney Caitlin McGillicuddy revealed details of an earlier juvenile case that had not previously been publicly reported.
According to McGillicuddy, investigators allegedly discovered videos on KJ's cellphone which purportedly showed him engaging in penetrative sex with a family member who was under 12 at the time.
The prosecutor said there were “multiple encounters” allegedly captured on the device and claimed the footage showed KJ using “predatory, derogatory” language toward the alleged victim.
“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” McGillicuddy told the court.
She also claimed KJ had previously faced a charge of sexual battery involving a victim under 16, although details of that case had not previously been reported publicly either.
McGillicuddy said KJ had been under court supervision since October 2025 in connection with the earlier matter, which she said was reported in April 2023.
However, KJ's attorney Jason Sheffield strongly disputed the characterization of that case.
In a statement, Sheffield said: “Characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.”
He added: “The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse or any comparable offense.”
Sheffield further argued that “any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”
The revelation came as KJ faces seven felony charges relating to a separate alleged sexual assault involving a female classmate, with those charges including aggravated sodomy and aggravated sexual battery.
Recent charges over alleged sexual assault on a 15-year-old
Prosecutors claim the alleged incident took place in April at a Life Time Fitness center in Alpharetta, Georgia, when KJ was 14 and the alleged victim was 15.
According to court documents, the girl described herself as the “best friend” of KJ's girlfriend and accused him of sexually assaulting her inside a co-ed sauna.
She alleged that KJ attempted “multiple times to have sexual intercourse with her by trying to pull down her pants” despite her refusing, with the allegations also including claims that he forced her to perform oral sex and digitally penetrated her before she managed to escape.
The alleged victim was medically examined the following day after telling her family what she said had happened. Court documents state that no male DNA was found in her mouth or vagina.
KJ was arrested on August 17 and remains at Atlanta's Metro Regional Youth Detention Center, where he has been held without bond.
His family and legal team have repeatedly denied the allegations.
At Friday's hearing, Sheffield asked Judge Melynee Leftridge to release KJ on a $65,000 bond, describing the teenager as quiet and saying the legal proceedings had taken a significant toll on him.
“This has been so traumatizing to [KJ] personally. He is not a boisterous kid. He is somewhat quiet,” Sheffield told the judge.
The attorney also pointed to KJ's school record, community involvement and football career.
“The accused turned 15 years old in May. He is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities,” Sheffield wrote in a previous filing.
“He is an accomplished football player who has received scholarship offers based upon his athletic ability.”
Sheffield proposed that Kim Zolciak, 48, supervise her son if he were released, saying she was currently at home and not employed, but prosecutors opposed the request.
McGillicuddy told the court that the alleged victim in the current sexual battery and sodomy case had suffered “documented physical injury” and described the alleged conduct as “predatory.”
She asked for bond to be set at $190,000.
A statement from the alleged victim was subsequently read in court, with the girl asking the judge to “consider [her] safety” before making a decision.
She said she had been “living in fear” because of alleged threats that KJ would target her if he were released.
“No matter who these threats came from directly, I cannot just ignore them or assume that nothing will happen,” she wrote.
“I am not only scared for myself anymore; I am scared for my family, too. Members of my family have received emails and phone calls because of this situation.”
She added: “The thought of him being released scares me more than I can put into words.”
Judge Leftridge said she would decide by Monday whether KJ should be granted bond.
Sheffield has said his client is “expecting to enter not guilty pleas to all charges” at his scheduled October 14 arraignment.
KJ, his attorney and his family have maintained that he is innocent, and following his arrest, Sheffield told Page Six: “The fact that he’s been arrested and is being held without bond is a tragedy. He is not only presumed innocent, but is, in fact, innocent.”
He added: “I’m asking the public not to presume the truth of these allegations and to give the families on both sides their space and privacy.”
The allegations against KJ have not been proven in court, and he remains legally presumed innocent unless and until proven guilty.
