Kim Zolciak’s son, Kroy Biermann Jr, has cited three reasons why he should be released from jail after his arrest on suspicion of sexual battery and sodomy.
A Georgia grand jury indicted the 15-year-old on Thursday (September 3) on charges including aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment, and three counts of sexual battery against a child under 16, according to People.
The charges stem from an alleged incident on April 23, 2026.
KJ, who is the son of Zolciak and Kroy Biermann, was apprehended in Alpharetta, Georgia, on August 17 and has since been held at Atlanta’s Metro Regional Youth Detention Center.
He is scheduled to appear in court on September 9.
His attorney, Jason B. Sheffield, has requested a bond hearing, citing the teenager’s academic record, football achievements, and strong family and community ties as reasons for his release.
In documents filed Wednesday, Sheffield described the 15-year-old as a good-standing student active inside and outside school.
"The accused turned 15 years old in May. He is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities," he argued, per Page Six. "He is an accomplished football player who has received scholarship offers based upon his athletic ability."
The lawyer also spoke about the teen's "substantial" family and community ties, noting that he "maintains a home and relationship" with his 48-year-old mom, who starred in Real Housewives of Atlanta, and his father.
KJ has "five siblings" and is "surrounded by an established community of extended family, friends, coaches, teachers, and others who remain actively involved in his life and continue to support him and his family during the pendency of these serious allegations."
According to Sheffield, those factors "are not merely favorable attributes" but "ties that bind [KJ] to his home, his school, his family, and this community."
He claimed they provide "structure, supervision, accountability and compelling reasons for him to remain here and comply with every condition imposed by this court."
The lawyer also pointed to KJ’s cooperation following the allegations.
Sheffield said the 15-year-old "participated in the development of evidence in his defense, including voluntarily submitting to a polygraph examination."
He argued the results "showed no deception when answering the two relevant questions concerning the alleged conduct."
Sheffield further contended that KJ "did not run from the allegation, from law enforcement or from this court” and “did not contact or intimidate witnesses."
"He is not only presumed innocent, but is, in fact, innocent," he previously insisted after news of the allegations emerged.
Sheffield has also asked that future developments in the case be redacted or sealed, and that courtroom proceedings be closed to the public.
He said the measures were necessary to "protect the accused and any other juvenile’s statutory confidentiality, privacy and fair-trial rights."
The lawyer said the "already difficult circumstances" have been "complicated by a wildfire of social-media activity and widespread media coverage," adding that "neither child chose this attention."
The allegations concern an encounter between KJ and a female classmate at the Life Time fitness center in Alpharetta in April.
The girl, who described herself as KJ’s "girlfriend’s best friend," accused him of sexually assaulting her during the encounter.
She was examined at Wellstar North Fulton Medical Center the following day, but no evidence of male DNA was found in her mouth or vagina.
Zolciak has publicly defended her son and denied the allegations against him.
"The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged," she said.
"My son voluntarily took a polygraph examination regarding these allegations and passed. Additionally, an examination was conducted, and no DNA belonging to my son was found," Zolciak added.
The former star warned about the consequences of false accusations while stressing the importance of investigating legitimate allegations.
"False accusations can have devastating consequences not only for the person being accused, but also for genuine survivors of sexual assault and abuse. Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence," she continued. "At the same time, no one should be publicly condemned based solely on an accusation.
"We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations," Zolciak concluded.
KJ is one of six children shared by Zolciak and Biermann, 40.
The estranged couple also share a son, Kash, 14, and twins Kaia and Kane, 12. Biermann adopted Zolciak’s daughters Ariana, 24, and Brielle, 29, from a previous relationship.
Zolciak and Biermann initially filed for divorce in April 2023 after roughly 12 years of marriage. They briefly called off the split before Biermann filed for divorce again in August 2023.
