Charlie Kirk's family has made a sweeping claim about his death, claiming that they intend to sue the security involved in the event in which he lost his life.
They said in a statement that they warned security about access to the rooftop, from which he was shot.
A chief allegedly reassured them before the event.
Turning Point USA founder Charlie Kirk lost his life at the event, hosted at Utah Valley University on September 10, 2025.
His family has now filed a notice of claim with intent to sue security involved in organizing the event, stating that 'failures not only robbed Charlie Kirk of his life', but 'robbed his family of their husband, father, son, and brother, with impacts that will compound for the rest of their lives'.
Tyler Robinson, 23, has since been charged with aggravated murder, felony discharge of a firearm, obstruction of justice, and witness tampering.
He has since pleaded not guilty to the murder of the conservative activist, with a judge ruling that prosecutors can seek the death penalty at trial.
Kirk family spokesperson Brett Parkinson wrote: "Charlie Kirk was violently and publicly assassinated while speaking at an event at Utah Valley University (UVU).
"His murder was entirely preventable and, in fact, would not have happened had the State of Utah and UVU followed through on their stated security promises, which included protecting the rooftops surrounding the quad where Charlie was speaking."
The family insists that security was warned 'multiple' times about the dangerous risk posed by the accessible rooftop, but concerns weren't addressed.
They alleged that TPUSA texted Police Chief Jeffrey Long, writing: "Hello Chief Long - we received this message today from the student group…. 'there is student roof access pretty close to where [Charlie Kirk] will be set up at Utah Valley'."
He then reportedly replied: "I got you covered."
The criminal case details that the shooter, who was located on the rooftop of the Losee Center, could target Kirk around 415 feet from where he was speaking.
Another argument from the family is that they should have considered the rooftop following the attempted assassination of Donald Trump in 2024.
Yet, just six campus officers were assigned to the event, which had three thousand students in attendance.
UVU Police have been accused by the family of failing to hold a security briefing before the event, as well as neglecting to monitor CCTV footage in 'real time'.
The notice further details: "If such footage had been monitored in real-time, Kirk's tragic death could have been avoided,
"Justice and accountability under the law are key tenets of the American judicial system.
"This claim preserves the right of Charlie Kirk’s family to pursue accountability for Charlie’s death," the statement concluded.
