Halle Berry's vicious custody battle with ex Olivier Martinez has finally been resolved and it's awful news for her
Halle Berry has been handed some unfortunate news in her custody battle with ex-husband Olivier Martinez.
The actress, 60, will remain without primary custody of her 13-year-old son, Maceo Robert Martinez.
Berry shares the teen with former husband Olivier Martinez, who accused her of physically abusing their child.
The news was delivered by Los Angeles Superior Court judge Shelley Kaufman on Thursday (October 29), and while she dismissed Martinez's request for a domestic violence restraining order, she denied Berry's requests for 50/50 custody and overnight visits.
USA TODAY reported that the former couple called it quits after two years of marriage in 2015, and had shared custody of their son until Martinez was granted a temporary restraining order earlier this month.
The French actor claimed the Berry 'attacked' Maceo on September 26, 'jumping on him, putting her hands around his neck, and choking him'.
Martinez's additional claims
Martinez, 60, claimed that there were previous instances of abuse from Berry towards their son, as he sought sole legal and physical custody.
Judge Shelley Kaufman ruled that the previous custody arrangement would stay in place, pending additional proceedings, while rejecting a permanent domestic violence restraining order.
So while Berry still holds joint legal custody, she has limited physical custody of her son.
The actress' attorney, Marina Beck, said in a statement to the publication: "We are extremely pleased that the Court has dissolved the TRO (Temporary Restraining Order).
"As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family."
Martinez's lawyer, Patrick Baghdaserians, also spoke out, telling TMZ that securing primary physical custody is a 'huge victory'.
Berry's attorney previously described Martinez's filing as 'entirely meritless and deliberately misleading', claiming that there is evidence that her ex violated court orders on numerous occasions.
The actors tied the knot in July 2013, welcoming Maceo later that same year, before filing for divorce in 2015 and having it finalized in 2023.
Following the eight-year legal tussle, they agreed to joint legal and physical custody of their son Maceo and for Martinez to receive $8,000 a month in child support.
Halle Berry's initial reaction to Martinez's claims
In a statement from Berry's attorneys seen by TMZ on October 1, they described Martinez's conduct as 'outrageous' and said the Monster's Ball star is 'deeply saddened' by the accusations lobbied at her by her ex-husband.
Berry's attorney stated: "In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive, and violent behavior.
"Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs."
Alongside Maceo, Berry also has an older daughter, 18-year-old Nahla, whom she shares with former partner Gabriel Aubry.
