Model Haley Baylee makes request to judge after being sued for ‘0.01%’ comments on NFL star ex-husband's manhood
Haley Kalil has filed a motion to dismiss a lawsuit brought against her by her ex-husband, former NFL player Matt Kalil. The lawsuit, filed on January 6, 2026, stems from comments Haley made during a livestream in November 2025.
In the stream, she discussed their marriage and personal life, which Matt claims led to unwanted public attention. Specifically, Matt alleges that Haley made “invasive commentary” about their sex life, including remarks about the size of his penis.
The legal battle began after Matt filed a lawsuit accusing Haley of invasion of privacy and unjust enrichment. He contends that her statements during the livestream, which gained significant public attention, have harmed his reputation and caused distress for both him and his family.
He also claims that Haley has profited from the backlash, benefiting from increased social media engagement and media coverage. The former couple, who were married from 2015 until their divorce in 2022, have found themselves at the center of a public dispute that has drawn significant media attention.
Haley Kalil’s response and legal stance
In response to the lawsuit, Haley has moved to have it dismissed, with her legal team citing the First Amendment as a key reason, People reports.
Haley's attorney, Matthew Bialick, explained that Minnesota upholds a strong commitment to free speech, which they believe should protect Haley’s right to speak about her own experiences.
The motion filed on January 23, 2026, argues that allowing the lawsuit to move forward would unnecessarily expand state laws, potentially infringing on protected speech.
"We moved to dismiss the complaint because Minnesota has a longstanding commitment to free speech, which is important now more than ever," Bialick stated. "Allowing a lawsuit to proceed against a woman for sharing a truthful, autobiographical account of sexual trauma would directly undermine those core values. We believe the motion will be granted."
While Haley’s legal team maintains that her comments were made within the boundaries of free expression, Matt’s attorney, Ryan Saba, disputes this reasoning.
He claims that Haley’s disclosures were excessive and intended to gain fame, noting that her actions caused harm to Matt and his family.
"A spouse does not have a right to expose private and confidential marital and sexual details for the purpose of profiting," Saba said, per People. "We expect that the motion will be completely denied."
Haley has also spoken out about the case, saying in a statement that she was "genuinely shocked and incredibly hurt upon receiving the news of this filing."
She added, "The truth is in the original livestream - which is still live on Marlon’s YouTube account. I speak highly of him in multiple ways throughout that conversation."
