Prize Draw Terms and Conditions
Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoters reserve the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions. Any decision of the Promoters is final, and no correspondence will be entered into.
1. Promoters
The Promoters of this prize draw are Taco Bell UK and Europe Limited, Company No. 92891700, Orion Gate, Guildford Road, Woking, Surrey GU22 7NJ, United Kingdom and VT, a trading style of Jungle Creations Limited (company no. 09127804) whose registered office is at 6 Batty Street, London, England, E1 1RH.
2. Entry Restrictions
The prize draw is open to all UK residents aged 18+ years or over (at the time of entry into the prize draw) who are born in the month of December, except employees, contractors, representatives, officers or directors of the Promoters, their families (whether or not living in the same household), agents, parent companies, subsidiaries, affiliates or any third party directly associated with administration of the prize draw.
3. Free Entry Route
The prize draw is free to enter.
4. How to Enter
To enter the prize draw, participants must:
- either:
- visit https://vt.co/news/taco-bell-lets-not-taco-bout-christmas-prize-draw directly; or
- log into their Instagram account and respond to a "call to action" advertisement about the prize draw on Instagram by swiping up which will take them to the promotional website, or on Facebook by clicking the link which will take them through to the promotional website; and
- enter their name, date of birth (which must fall in the month of December), email address, phone number, and home address,
between the opening date and closing date set out below.
Only one entry per person is permitted. Internet access, an Instagram or Facebook account, and an email address are required to enter the prize draw. The Promoters reserve the right to verify the eligibility of any participant. The Promoters may require such information, as they consider reasonably necessary for this purpose.
Entries generated by script, macro, mechanical or other automated means are prohibited and will cause disqualification. Multiple entries made through agents, third parties, organised groups or any entry duplication method will not be accepted and will not be entitled to receive a prize.
The Promoters reserve the right to disqualify any entrant participant they believe not to be participating within the spirit of the prize draw or suspects of participating in any unfair or unjust behaviour. The Promoters reserve the right to use their discretion in all respects and to enforce any penalty or sanction they deem appropriate.
Entries that are not submitted in accordance with these terms and/or that are delayed, damaged, incomplete, altered, illegible or otherwise defective will be disqualified and not eligible to receive a prize.
5. Starting Date and Closing Date
The opening date for entries is 5pm (local UK time) on 9th November 2021.
The closing date of the prize draw is 5pm (local time) on 26th November 2021. Entries received after this time will not be counted, valid, accepted or considered.
The prize draw may be withdrawn at any time, in the event of circumstances outside of the Promoters' reasonable control, which they consider make it necessary to do so. In such circumstances, the Promoters shall exercise all reasonable precautions and due diligence to avoid withdrawing the prize draw.
6. Lost or Delayed Entries
The Promoters accept no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure beyond their reasonable control.
7. Draw and Mechanism
Three winners will be chosen by random (performed by a computer process) on November 26, 2021. The winner then be notified within 1 day and announced on 2nd December, 2021.
8. The Prize
The winner will receive the prize of: Birthday themed Taco Bell goodies, including but not limited to: Taco Bell party merchandise, cards and party games, Taco Bell socks, a Taco Bell t-shirt, Taco Bell shirts, Taco Bell balloons, and a £50 Taco Bell voucher.
The prize will be delivered to the postal address supplied by the winner within 30 days of the closing date of the prize draw.
The prize is non-transferable and non-refundable. Subject to these terms and conditions, there is no cash alternative to the prize, except in the event of circumstances outside the Promoters’ reasonable control, where the Promoters reserve the right to substitute a similar or alternative prize of equivalent or greater value.
9. Notification of and Withholding Prizes
The winner will be notified by email and phone. If, despite the Promoters’ best endeavours, they are not able to contact the winner, Promoters will not need to award the prize
If a winner does not respond to the Promoters within 24 hours of being notified by the Promoters, then the winner's prize will be forfeited and the Promoters will be entitled to select another winner in accordance with the process described herein.
10. Winner Details
The Promoters must either publish or make available information that indicates that a valid award has taken place. To comply with this obligation, the Promoters will (unless the winner has objected on lawful grounds – see clause 11 ‘Publicity’ below) send details of the winner's Instagram page, name, county and the prize won to anyone who writes to Jungle Creations Limited (enclosing a self-addressed envelope) within 1 month after the closing date stated in clause 5. Entrants can object to disclosure of their name and county, or request that disclosure be limited in scope by contacting Emily Habin at the above-named address. The Promoters may nevertheless disclose the information to the Advertising Standards Authority or other competent regulatory authority if required to do so.
11. Publicity
The Promoters may request that any winner take part in non-paid publicity or advertising relating to the prize draw, which may include having their photograph taken for promotional and/or press purposes.
The winner can opt-out of this obligation, or withdraw consent, at any time.
12. Limiting the Promoters' Liability
The Promoters will award the prize as described in these terms, but insofar as is permitted by law, the Promoters, their agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoters, their agents or distributors or that of their employees. Your statutory rights are not affected.
13. Use of Personal Data
These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of these terms and conditions and by participating all participants will be deemed to have accepted and be bound by them. Entrants are strongly encouraged to retain a copy for information.
The Promoters take data protection seriously. By entering this prize draw, entrants confirm that they have read the Promoters privacy notice posted at [https://www.tacobell.co.uk/terms-and-conditions-directory] and agree to these terms and conditions of the prize draw. By submitting any information required as part of their participation into the prize draw, entrants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR).
The Promoters will only use the personal details supplied for the administration of the prize draw and the auditing of the entries where necessary and for no other purpose, unless the Promoters have the entrants consent and have opted-in to receive future marketing communications. The entrants personal details will at all times be kept confidential, and in accordance with the General Data Protection Regulation (GDPR). Entrants can request access to their personal data, or have any inaccuracies rectified, or request deletion of data by sending an email to [email protected].
By participating in the prize draw, entrants agree to the use of personal data as described here. Entrants can withdraw your consent at any time.
14. Governing Law and Jurisdiction
The prize draw and these terms (including any non-contractual disputes or claims arising out of them) will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts. Consumers in Scotland and Northern Ireland may additionally bring an action in their home courts.
