As previously reported, last month, Kiser's three-year-old son, Trigg, died after tragically drowning at the family home.
On May 12, Chandler Police were called to the 26-year-old’s home in Arizona, roughly 25 miles from Phoenix, after reports of a possible drowning.
Officers arrived to find Trigg had fallen into the family’s pool. He suffered multiple injuries before being pulled out of the water.
CPR was performed immediately, and paramedics transported the toddler first to Chandler Regional Hospital, then by air to Phoenix Children’s Hospital, where he tragically died six days later, on May 18.
Now, further details have been shared, with reports claiming that Kiser was not at home when the tragedy occurred.
According to reports from the New York Post, Kiser has also filed a lawsuit in Arizona Superior Court for Maricopa County calling for all records pertaining to her son's death to remain sealed and out of the public view.

Among these is reportedly distressing footage of the incident, which Kiser wishes to remain sealed so that she does not have to “relive the aftermath through viral” videos.
She was granted temporary confidentiality on her larger request for privacy on June 3, with records set to remain sealed until a ruling on the larger privacy issue takes place.
In the filing, Kiser's lawyer stated that the family "desperately want to grieve in private, but sadly, the public will not let them," adding that Trigg's death "has become a media frenzy."
The insider added to the outlet: "With her motion, Emilie Kiser is urging the court to keep private the footage and records related to her young son’s death — a deeply personal, and reasonable, plea to prevent the public release of the most traumatic moment of her life."
The source added that while Kiser's "public profile does not negate her right to privacy," it also doesn’t "make her son’s death a matter for public consumption," alleging that there have already been "over 100+ public records requests for the footage of a toddler’s death, which only serves to satisfy morbid curiosity more than any type of justice."
Following Trigg's death on May 18, police launched an investigation into his passing, which was deemed an accidental drowning.

Kiser’s legal team also released a public statement about the "heartbreaking accidental drowning", adding: "Emilie is going through a parent’s worst nightmare right now. She lost her young son.
"Emilie is trying her best to be there for her surviving son, two-month-old Theodore. But every day is a battle."
Kiser and her husband Brady Chapman welcomed their second child, baby Theodore - nicknamed Teddy - in March.
Trigg frequently appeared in Kiser’s videos, which focus on parenting, lifestyle, and family life, shared to a following of 3.3 million TikTok fans.
Following the birth of her youngest son, Kiser shared a heartfelt post with fans: "There’s no word to describe finally meeting Teddy and finally getting to analyze every part of him and how perfect he is. I’d do it all over again solely for the moment of Brady holding up our baby and announcing him to me."
She added: "More to come. We have been soaking up every second as a family of FOUR."
Our thoughts remain with the family at this devastating time.
