Trigg Chapman, the three-year-old son of viral parenting influencer Emilie Kiser, died after drowning in the backyard pool of their Chandler, Arizona, home.

The incident occurred on May 12, and after six days in critical condition, Trigg passed away on May 18.

In a statement to PEOPLE, Chandler Police said: "Our thoughts and deepest condolences are with the child's family and loved ones during this unimaginable time.

"The investigation into the circumstances surrounding this incident remain ongoing. This is still an open investigation. Out of respect for the family’s privacy, we will not be releasing additional details until the investigation is closed."

According to search warrant applications obtained by USA Today, Emilie’s husband, Brady Chapman, was watching their newborn son, Theodore, when Trigg tragically slipped out of sight.

Brady told police he lost track of the toddler for “three to five minutes” before discovering him floating in the backyard pool.

The documents confirm that only Brady and the two children were home at the time. Emilie was reportedly out with friends when the tragedy happened, per People.

According to reports from the New York Post, officers from Chandler Police responded to a possible drowning at the family’s residence, about 25 miles from Phoenix.

Trigg was unresponsive, having suffered multiple injuries, and emergency responders immediately performed CPR.

He was rushed to Chandler Regional Hospital and later airlifted to Phoenix Children’s Hospital, where he died on May 18.

As the media frenzy around the tragedy escalated, Emilie took legal action to protect her family's trauma from being exposed.

On May 27, she filed a lawsuit in Arizona Superior Court for Maricopa County, requesting that all public records, including disturbing video footage of the accident, be sealed, per the New York Post.

She fears the material could go viral and force her to “relive the aftermath” endlessly.

Her filing states that the City of Chandler and the Maricopa County Medical Examiner’s Office have already received over 100 public records requests for materials tied to Trigg’s death.

Emilie submitted a personal declaration as part of the lawsuit, detailing her grief and trauma. On June 3, the court granted her temporary confidentiality, ruling that the records and her declaration remain sealed until a final decision is made.

Her legal team echoed those sentiments in a public statement: "Emilie is going through a parent’s worst nightmare right now. She lost her young son. Emilie is trying her best to be there for her surviving son, two-month-old Theodore. But every day is a battle."

Emilie and Brady had only recently welcomed their second child in March. She had shared emotional posts about the joy of meeting baby Theodore, also nicknamed Teddy.

"There’s no word to describe finally meeting Teddy and finally getting to analyze every part of him and how perfect he is. I’d do it all over again solely for the moment of Brady holding up our baby and announcing him to me," she posted.

"More to come. We have been soaking up every second as a family of FOUR."

Our thoughts are with the family at this difficult time.
